Terms and conditions

1. Definitions

  1. Regulations – a document setting out the rules and conditions for the services provided by the Seller and the conditions under which the Buyer makes purchases in the Online Store.
  2. Buyer – a natural or legal person who purchases Goods or services offered by the Seller via the Online Store under a Sales Agreement.
  3. Buyer other than a consumer – a legal person that concludes an Agreement with the Seller within the Online Store directly connected with its business or professional activity.
  4. Consumer – a natural person who concludes an Agreement with the Seller within the Online Store that is not directly connected with their business or professional activity.
  5. Data Controller – Sensimilla sp. z o.o. (Tax ID/NIP: 6762642071), the entity responsible for processing personal data in the Online Store.
  6. Goods – any tangible product offered for sale or made available in the Online Store that may be the subject of a Sales Agreement.
  7. Seller – Sensimilla sp. z o.o. (Tax ID/NIP: 6762642071), the business entity offering Goods or services for sale via the Online Store and entering into a Sales Agreement with the Buyer.
  8. Order – the Buyer’s submission to purchase specified Goods or services by completing the appropriate Order Form for the purpose of concluding a Sales Agreement.
  9. Sales Agreement – a legally binding agreement between the Seller and the Buyer regarding the purchase of Goods or services via the Online Store.
  10. Order Form – an interactive document or section on the Online Store website through which the Buyer enters and submits Orders for products or services to the Seller.
  11. Online Store – the electronic platform at www.seedweed.pl
    operated by the Seller (Sensimilla sp. z o.o., NIP 6762642071) enabling electronic purchases.
  12. User – an adult who uses the functionalities offered by the Online Store.
  13. Account – an individual, personalized space in the Online Store that allows the User to access features and services and to store data related to Orders.
  14. Registration Form – an interactive form available on the Online Store website in which the User provides the personal data and information necessary to create an Account and use the Store’s services and features.
  15. Review – a voluntary assessment or comment by the Buyer about Goods or services in the Online Store.

2. Prerequisite for using the Online Store

  1. The Goods offered by the Seed Weed Online Store are intended exclusively for adults who are 18 years of age or older. If a minor accesses this website, these Regulations require them to leave the site immediately.
  2. By accepting these Regulations and placing an Order on our site, the Buyer expressly declares that they do not intend to use seeds for cultivation purposes.
  3. These Regulations inform about the legal status of the Goods sold in the Online Store and state that the Buyer is fully responsible for complying with local regulations regarding cannabis seeds and the Goods sold in the Seed Weed Online Store.
  4. Product descriptions in the Online Store are of a scientific and educational nature. All product descriptions posted in the Online Store are protected by copyright and are the property of the Seller. They are created on the basis of original information provided by manufacturers, with SEO best practices in mind.

3. Terms of electronic service provision

  1. These Regulations establish the conditions for the Seller’s sale of Goods via the Online Store and the use of services provided electronically.
  2. Minimum technical requirements to use electronic services:
    • Internet access;
    • a web browser;
    • a standard operating system.
  3. The Sales Agreement is concluded between the Buyer and the Seller by the Buyer submitting an Order via the Order Form available in the Online Store.
  4. The Service Provider uses cookies; full information is available in the Privacy Policy section.

4. Goods and prices

  1. The Seed Weed Online Store ensures that all Goods offered comply with applicable law, in particular the Act on Counteracting Drug Addiction. We emphasize that all Goods are fully legal and are not classified as illegal substances or precursors.
  2. Within the Store’s offer, cannabis seeds are available for collection purposes only. We do not recommend or support any activities contrary to applicable law in connection with these products. Germination and cultivation of cannabis in Poland are strictly prohibited by law and subject to legal penalties. We remind you of the obligation to comply with these regulations.
  3. By accepting the Regulations and placing an Order, the Buyer confirms their awareness of the legal regulations and conditions concerning the legality of the products offered in the Online Store and undertakes to comply with these regulations.
  4. All product prices displayed at www.seedweed.pl
    are quoted in Polish zloty (PLN) and include applicable VAT. Delivery costs are not included.
  5. The Seller reserves the right to change product prices, introduce new products, organize or cancel promotional campaigns, and modify them.

5. Payment terms

  1. After the Buyer’s Order is accepted, payment for the Goods must be made without delay, or paid upon collection from the courier company (if the Buyer selected cash on delivery).
  2. Available payment methods in the Seed Weed Online Store:
    • Bank transfer;
    • Electronic payment system CashBill;
    • Cash on delivery (payment upon receipt).
  3. Upon receiving payment confirmation from the Buyer, the Seller immediately proceeds to fulfill the Order.

6. Complaints

  1. The Seller is liable to the Buyer who is a Consumer for the conformity of the Goods with the Sales Agreement in the event of physical or legal defects, as specified in Title XI, Section II of the Civil Code.
  2. The Seller’s liability under statutory warranty (rękojmia) towards Buyers who are not consumers is defined by the Civil Code of 23 April 1964 (Journal of Laws 1964 No. 16, item 93, as amended), in accordance with the principles contained therein.
  3. The Buyer is obliged to immediately check the condition of the shipment upon receipt of the Order, paying particular attention to any damage to the packaging and security seals.
  4. If shipment damage is detected, the Buyer must notify the courier and immediately inform the Online Store at [email protected]
    or by phone at +48 790 361 522.
  5. Under the Sales Agreement, the Buyer must notify the Seller of any non-conformity of the Goods with the Sales Agreement upon discovery. A complaint may be submitted by:
    • completing the complaint form,
    • sending a notice to [email protected]
    • submitting a report by phone at +48 790 361 522.
  6. A Buyer sending the complained Goods to the Seller must include a written statement containing:
    • name and surname or business name of the complainant;
    • full residential or registered address;
    • email address;
    • date of purchase;
    • product name;
    • purchase price;
    • detailed description of the defect and circumstances of its occurrence;
    • the complainant’s demands.
  7. The Buyer should also attach proof of purchase, in particular the original or a copy of the receipt, VAT invoice, or other document confirming the purchase. The Seller does not accept cash-on-delivery parcels or shipments at the recipient’s expense.
  8. The Seller must respond to the Buyer’s complaint promptly and no later than 14 calendar days from the date of receipt of the complained Goods.
  9. If the purchased Goods do not comply with the Sales Agreement, the Buyer is entitled to, among others:
    • request replacement or repair of the Goods;
    • seek a price reduction;
    • request a partial refund.
  10. If the complaint procedure requirements are not met, the complaint may be rejected and not recognized by the Seller.

7. Withdrawal from the sales agreement

  1. Under the laws of the Republic of Poland, the Buyer has the right to withdraw from the Sales Agreement without stating reasons within 14 days from the date of receipt of the Goods, provided the Goods are returned to ul. Mazowiecka 6/8, ap. 414, 00-048 Warsaw, Poland.
  2. A Buyer may withdraw from the Sales Agreement by sending a statement to [email protected] or in any other unambiguous manner, observing the required form and deadline.
  3. The Seller does not accept cash-on-delivery parcels or shipments at the recipient’s expense.
  4. In case of withdrawal, the Goods must be complete and bear no signs of use or damage of any kind.
  5. Refunds will be made using the same payment method used by the Buyer, unless the Buyer expressly agrees to a different method that does not incur costs for them.

8. Delivery costs, methods and timeframe

  1. Shipments are delivered according to the Buyer’s chosen delivery method:
    • InPost;
    • Personal collection;
    • Poland Post;
    • International shipping via DHL.
  2. The delivery period begins on the date the payment is credited to the Seller’s bank or settlement account and is calculated in business days.
  3. The Buyer bears the delivery costs unless the Sales Agreement provides otherwise. Fees for delivery services (transport, postal services) are disclosed on the Online Store pages and during the ordering process.
  4. The Seller is responsible for timely dispatch but is not liable for unforeseen delivery disruptions due to factors beyond their control.
  5. Orders are dispatched within up to 5 business days; this period may change depending on circumstances specified in the product description.
  6. If a parcel is not collected by the Buyer for reasons beyond the Seller’s control, it may be re-sent. The Buyer must cover the costs of the parcel’s return to the Seller and re-shipment. The parcel will be re-shipped only after all such charges are settled.
  7. If the Buyer provides incorrect or incomplete data, the Seller is not responsible for delays or non-delivery of the Order.

9. Personal data in the Online Store

  1. The Seller is the Data Controller of personal data processed for the purpose of implementing these Regulations.
  2. Use of the Online Store does not require providing personal data; however, in certain situations explained during use of the Store, refusal to provide data may prevent placing an Order. The decision to provide data always rests with the Buyer and is entirely voluntary.
  3. Any person whose personal data is processed by the Data Controller has the right to access their personal data, to rectify it, and to request cessation of processing or deletion.
  4. Personal data of Buyers may be shared with entities associated with the Online Store. In the case of electronic payments or card payments, the Data Controller may share the Buyer’s personal data with the selected payment service provider handling transactions in the Online Store. Additionally, if the Buyer chooses delivery via a courier company, the Data Controller may share the Buyer’s personal data with the relevant carrier or intermediary responsible for delivering Orders for the Seller.
  5. The Seed Weed Online Store guarantees comprehensive privacy protection of personal data provided by the Buyer, preventing access by third parties and disclosure of such information. However, there are situations where disclosure may be required by law (e.g., at the request of authorities such as the Tax Office or the Social Insurance Institution).

  7. The rules for processing personal data are strictly defined and described in detail in the Privacy Policy.

10. Account creation and login

  1. To access the full functionality of the Online Store, creating an Account is required.
  2. To create an Account, complete a short Registration Form by providing the necessary personal data.
    • For natural persons:
      • first name, last name,
      • email address,
      • password,
      • contact number,
      • delivery address.
    • For companies:
      • Tax ID (NIP),
      • email address,
      • password,
      • contact number,
      • billing address,
      • delivery address.
  3. By submitting the Registration Form, the User declares and warrants that:
    • The information provided in the Registration Form is complete and reflects the actual state of affairs.
    • All information provided is true and not misleading.
    • The User has full authority to conclude a Sales Agreement in accordance with applicable law.
    • The information provided does not infringe third-party rights, including copyrights, intellectual property rights, or other rights.
    • The User has read these Regulations and undertakes to comply with all their provisions.
  4. Creating an Account enables access to personalized features such as managing personal data, order history, preferences, and quick ordering.
  5. Registered Users may log in to their Account using their email address and password.
  6. A User may not use another User’s Account or share their own Account with others. Users are responsible for maintaining the confidentiality of their login credentials.
  7. The Buyer agrees to comply with the rules for registration, maintaining the confidentiality of login data, and using the Account in accordance with these Regulations.
  8. To verify the personal data provided, the Seller may contact the Buyer by phone or send a message to the email address provided.
  9. The data provided in the Registration Form are stored in the User’s Account. If any data change, the User must promptly update them in their Account.
  10. If the Buyer fails to update their profile upon actual changes to their data, the Seller is not liable for non-delivery or delay of the Order.
  11. User data will be processed for the performance of concluded agreements, including:
    • Establishing and maintaining business relationships and performing the Sales Agreement/contract (e.g., accepting Orders, providing services, order handling, issuing invoices) in accordance with the GDPR;
    • Pursuing or defending claims and conducting direct marketing activities (where consent is given) as the Data Controller’s legitimate interests under the GDPR;
    • Fulfilling legal obligations or performing tasks in the public interest in accordance with the GDPR.

11. Reviews

  1. The Buyer may leave Reviews about products and services offered at www.seedweed.pl
  2. Reviews are voluntary and reflect the Buyer’s subjective assessment of a given Good or service.
  3. Reviews should be truthful and based on the Buyer’s personal experience.
  4. The Seller encourages constructive Reviews, remarks, and recommendations that may help other Buyers make purchasing decisions.
  5. The Online Store reserves the right to moderate and remove Reviews that violate the Regulations or infringe third-party rights.
  6. The Seller is not liable for any damage resulting from reliance on content posted in Reviews.
  7. Users who post Reviews in the Online Store bear full legal responsibility for the content of their entries.
  8. The Online Store reserves the right to use Buyers’ Reviews for marketing, promotional, or informational purposes, with respect for privacy rights.
  9. By posting a Review, the Buyer agrees to the processing of their personal data in accordance with the Store’s Privacy Policy.

12. Final provisions

  1. These Regulations enter into force on June 1, 2023.
  2. The current version of the Regulations is available to the User at www.seedweed.pl/en/regulamin.
  3. The Seller reserves the right to make unilateral changes or updates to these Regulations, of which the Buyer will be notified electronically. The changes will take effect in accordance with the date specified in the notice.
  4. In the situation described in the preceding point, the Buyer may immediately terminate the Sales Agreement upon receiving information about the changes by notifying the Seller electronically at [email protected]
    . If the Buyer does not inform the Seller, this constitutes acceptance of the amended Regulations.
  5.
